Terms of Service

Welcome to the services of Smiling Cube Studios V.O.F. ("Smiling Cube Studios", "we", "our"), located at Craneveldstraat 109, 5914 SH Venlo, The Netherlands. These Terms of Service and our Privacy Policy govern the relationship between you and Smiling Cube Studios and they apply to the use of all our services ("our services") like, but not limited to, our website(s) and all apps developed or published by Smiling Cube Studios.

By downloading, installing and using our services you agree to these terms. You may not download, install, access, or use our services when you do not agree to these terms and conditions. Smiling Cube Studios reserves the right to change these terms at any time.

You may use our services when you are 16 years of age or older and are not barred from using our services under applicable law. If you are under the age of 18, or under the age of majority where you live, you represent that your legal guardian has reviewed and agreed to these terms.

These terms of service are governed by the laws of the Netherlands, and all parties submit to the non-exclusive jurisdiction of the courts of the Netherlands. When you access our services through a mobile network, your network provider's data and fees will apply.

License

Subject to your agreement and continuing compliance with these Terms, we give you a personal, non-exclusive, non-transferable, non-sublicensable, revocable limited license to access and use our services for your own non-commercial entertainment purposes. You shall not sell, rent or give away your access to our services. You agree not to use these services for any other purpose.

You agree that you will not, under any circumstances:

• use our services for fraudulent or abusive purposes. You cannot impersonate any person or entity, or otherwise misrepresent Smiling Cube Studios' affiliation with any person, entity or our service;
• interfere with or disrupt our services;
• attempt to decompile, reverse engineer, disassemble or hack any of our services, or to defeat or overcome any of the encryption technologies or security measures or data transmitted, processed, stored or used by Smiling Cube Studios;
• post any information that contains nudity, violence, or offensive matters or that contains a link to such content. Under no circumstances will you post any information that is abusive, threatening, obscene, defamatory or information that is offensive to someone or information that can harm someone;
• attempt to, or harass, abuse, or harm another person or group, including other players using our services and employees of Smiling Cube Studios;
• harvest, scrape or collect any information about or regarding other people that use our services or employees of Smiling Cube Studios;
• disrupt the game flow or otherwise act in a manner that negatively affects other players' ability to compete fairly in our services;
• institute, assist or become involved in any type of attack on our services or on people using our services;
• disobey any requirements or regulations of any network connected to our services;
• do anything else that Smiling Cube Studios deems not to be within the spirit of fair play or the intent of our service.

You acknowledge and agree that you are solely responsible for your actions in our services. Smiling Cube Studios reserves the right to determine what conduct it considers to be in violation of these Terms or other rules of our services and reserves the right to take action as a result, which may include terminating your access to the services.

Third-party services and content

Our services may contain links to websites or services operated by third parties or use features, content or services which are made available by third parties. For example (but not limited to) the posting of videos or sharing information on other platforms. The use of any of these websites or services operated by third parties shall be, in addition to these terms, subject to the relevant terms and conditions of these third parties. Smiling Cube Studios assumes no responsibility for such third-party services or content in third-party services.

Intellectual property

All rights, title and interest in and to our services (including without limitation any games, titles, icons, logo, computer code, characters, artwork, animations) are owned by or licensed directly or indirectly to Smiling Cube Studios. Smiling Cube Studios reserves all rights, including without limitation, all intellectual property rights or other proprietary rights, in connection with its games and its services.

We respect artists and content owner rights. If you believe that your copyrighted work has been used in our services without license, please contact us at info@smilingcube.com.

Virtual items

Smiling Cube Studios owns, has licensed or otherwise has rights to use all of the content that appears in our services. You agree that you have no right or title in or to any content in our services including without limitation the virtual goods or currency appearing or originating in any part from our services.

Purchases

In our services you may use real-world money to purchase a limited, personal, non-transferable, non-sublicensable, revocable license to use virtual currency, virtual in-game items and gain access to additional functionalities. You are only allowed to purchase these virtual items from us and our authorized partners through our services and not in any other way.

The transfer of virtual items is prohibited. You shall not sell, purchase or redeem virtual items to any other person. All purchases and redemptions of virtual items and subscriptions made through our services are final and non-refundable.

Social media and game content

With the limitations set in these terms and conditions, you have the right to upload or share captures (such as audio, video or screenshots) of our services to social media services like Twitter, Facebook, Instagram or YouTube. All such material must be shared without editing it in such a way that it will misrepresent our services.

Disclaimer of warranties

Our services are provided on an "as is" and "as available" basis for your use, without any warranties of any kind. To the maximum extent permitted by law, Smiling Cube Studios shall not be liable to you for any indirect, incidental, consequential, special, punitive or other similar damages, including but not limited to loss of revenues, lost profits, device failure, lost data or business interruption or other intangible losses. Smiling Cube Studios shall not be liable to you for more than the amount you have paid to Smiling Cube Studios, in accordance with these terms, in the six months immediately preceding the date on which you first assert a claim. You acknowledge and agree that if you have not paid anything to Smiling Cube Studios during such time, your sole remedy for any dispute with Smiling Cube Studios is to stop using our services.

Dispute resolution and law

If a dispute arises between you and Smiling Cube Studios, we advise you to first contact us at info@smilingcube.com. All disputes between you and Smiling Cube Studios shall be governed by the laws of the Netherlands, without regard to conflict of law provisions. You agree that any claim or dispute you may have against Smiling Cube Studios must be resolved exclusively by a court in the Netherlands.
